Patent Law 专利法

Patent Law 专利法

To get a patent, the invention must meet certain criteria, including being novel (not previously known), non-obvious (not something that would be obvious to someone skilled in the field), and useful (having a practical application).

To obtain a patent in Malaysia,  the inventor must make an application to the Intellectual Property Corporation of Malaysia (“MyIPO”). The inventor will request that a patent be granted and set out the specification of the invention. The specification includes a description of the invention and the inventor’s claims.

Steps to File a Patent in Malaysia 在马来西亚申请专利的步骤

  1. Determine Patentability: First, ensure your invention is eligible for a patent. It must be new, involve an inventive step, and be capable of industrial application.
  2. Conduct a Patent Search: Perform a thorough search to check if your invention is already patented or if similar inventions exist.
  3. Prepare Patent Application: Prepare your patent application, including a detailed description of your invention, claims that define the scope of protection, and any necessary drawings or diagrams.
  4. File the Application: Submit your patent application to the Intellectual Property Corporation of Malaysia (MyIPO). Include all required forms, fees, and supporting documents.
  5. Examination: Your application will undergo a substantive examination by MyIPO to assess the patentability of your invention. This includes checking for novelty, inventive steps, and industrial applicability.
  6. Publication: Once your application meets the requirements, it will be published in the Malaysian Official Gazette.
  7. Opposition Period: There is a period during which third parties can oppose your patent application if they believe it does not meet patentability criteria.
  8. Grant: If there are no oppositions or if they are resolved in your favor, MyIPO will grant your patent. You will then receive a patent certificate.
  9. Maintenance: Pay the required maintenance fees to keep your patent in force for the full term (usually 20 years from the filing date).

Solar Panel

Imagine a window that not only lets light in but also generates electricity. Inside, tiny solar cells turn sunlight into power, which is converted into usable electricity by devices on the window’s edge. These windows are easy to install and provide solar-generated electricity directly to buildings.

 Vinod Grover

Partitioning CUDA code for execution by a general purpose processor

This invention involves a method to run parallel programming applications designed for multi-core GPUs on general-purpose CPUs. A translator converts GPU-specific parts of the program for CPU execution. The program is divided into sections with synchronized instructions, categorized as convergent or divergent. Divergent memory references shared across sections are duplicated, and thread loops are added to ensure proper memory sharing among threads during CPU execution.

 Makoto Aikawa

RFID Reader With Integrated Location Sensing

The abstract of the patent describes an RFID reader device with integrated location sensing capabilities. This technology aims to improve the accuracy and efficiency of RFID systems by incorporating location information into the RFID reading process. By determining the physical location of tagged objects more precisely, this system enhances applications such as inventory management, asset tracking, and logistics.

John C Gibson

Foldable smartphone and tablet holder stand

This patent illustrates a phone holder design that allows you to sit your phone on the table at multiple angles. With the hinge design accompanied with multiple slots at the back, it allows your phone to rest on the table with multiple angles.

Roof mounted occupant restraint system

The vehicle’s safety system comprises two roof-mounted airbags, each dedicated to one occupant. These airbags can switch from a stored to a deployed state, aligning with the occupants for optimal protection. When deployed, they are positioned apart from each other to provide individualized safety. A tether connects them, restricting their movement relative to each other in case of occupant intrusion, thereby enhancing their effectiveness in safeguarding the occupants.
