Patent Law 专利法

 

To get a patent, the invention must meet certain criteria, including being novel (not previously known), non-obvious (not something that would be obvious to someone skilled in the field), and useful (having a practical application).

To obtain a patent in Malaysia,  the inventor must make an application to the Intellectual Property Corporation of Malaysia (“MyIPO”). The inventor will request that a patent be granted and set out the specification of the invention. The specification includes a description of the invention and the inventor’s claims.

 

为了获得专利,发明必须符合特定的标准,包括新颖(以前未知),非显而易见(不是对该领域的专业人士显而易见的事物),以及有用(具有实际应用)。

要在马来西亚获得专利,发明人必须向马来西亚知识产权局(“MyIPO”)提交申请。发明人将请求授予专利,并说明发明的具体内容。该说明包括发明的描述和发明人的权利要求。

 

Steps to File a Patent in Malaysia 在马来西亚申请专利的步骤


  1. Determine Patentability: First, ensure your invention is eligible for a patent. It must be new, involve an inventive step, and be capable of industrial application.
  2. Conduct a Patent Search: Perform a thorough search to check if your invention is already patented or if similar inventions exist.
  3. Prepare Patent Application: Prepare your patent application, including a detailed description of your invention, claims that define the scope of protection, and any necessary drawings or diagrams.
  4. File the Application: Submit your patent application to the Intellectual Property Corporation of Malaysia (MyIPO). Include all required forms, fees, and supporting documents.
  5. Examination: Your application will undergo a substantive examination by MyIPO to assess the patentability of your invention. This includes checking for novelty, inventive steps, and industrial applicability.
  6. Publication: Once your application meets the requirements, it will be published in the Malaysian Official Gazette.
  7. Opposition Period: There is a period during which third parties can oppose your patent application if they believe it does not meet patentability criteria.
  8. Grant: If there are no oppositions or if they are resolved in your favor, MyIPO will grant your patent. You will then receive a patent certificate.
  9. Maintenance: Pay the required maintenance fees to keep your patent in force for the full term (usually 20 years from the filing date).
